The Healthiest Nation in One Generation was created and is managed by the American Public Health Association. Your use of this site is subject to the following terms of use agreement. Please review this information carefully. By accessing and using the site, you agree to be legally bound by all of the terms, conditions and notices contained or referenced herein.

1.  Minors and under age 13.  Minors must be supervised by a parent or legal guardian, and the parent or guardian must agree on their behalf, and on behalf of the minor, to these Terms. We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to post to the Site. If you are under 13, please do not attempt to post or send any information about yourself to us, including your name, address, telephone number, or e-mail address. If you become aware that we have collected personal information from a child under age 13 without verification of parental consent, please provide notice to us at the address provided in Section 10, below.

2. Privacy. Please review our privacy policy, which also governs your use of the service, to understand our data collection, use, and disclosure practices.

3.   Copyright Rights. Any main content on the service is subject to copyrights owned by the American Public Health Association and other individuals or entities and are protected by United States and international copyright laws. Any reproduction, retransmission or republication, of all or part of any document found on the service is expressly prohibited unless the American Public Health Association or the copyright owner of the material has expressly granted its prior consent for such use.

4.   Trade and Service Mark Rights. The names, trademarks, service marks, and logos of the American Public Health Association belong exclusively to the American Public Health Association and are protected from reproduction, imitation, dilution or confusing or misleading uses under national and international trademark and copyright laws. All other trademarks, services marks, and logos (including third-party product names) are the property of their respective owners. The use or misuse of these trademarks or any materials is expressly prohibited and nothing stated or implied on this service confers on you any license or right under any patent or trademark of the American Public Health Association or any third party.

5.   Links to Third-Party Services. The American Public Health Association does not control third-party sites that may be linked to from the site. The American Public Health Association cannot monitor or otherwise evaluate such sites, and the American Public Health Association is not responsible for any of their contents, features, codes, underlying materials, terms of access or privacy policies. Even if you are linked to a Web page other than the front page of the linked site, you are responsible for checking that site’s terms and conditions of access and use, as well as the site’s privacy policies.

6. Products and Services. Products and services offered through this site or shown or discussed on this site may be subject to disclaimers and license terms and terms of use or sale that are in addition to, or distinct from, these terms. Therefore, the provision and acceptance of any such product or service shall be subject to any additional third-party supplier(s) of the products or services. The accuracy of the colors depicted on this site, such as colors of products, will depend upon your monitor. Therefore, we cannot guarantee that your monitor’s display of any color will be accurate.

7.   Obligations. You are required to comply with all applicable laws in connection with your use of the service, and such further limitations as may be set forth in any written or on-screen notice from the American Public Health Association. As a condition of your use of the service, you warrant that you will not use the service for any purpose that is unlawful. The American Public Health Association reserves the right to review postings and profiles on its service, to remove any postings and profiles, and to terminate your ability to post to the service at any time without notice, in its sole discretion. The American Public Health Association also reserves the right to disclose any information necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to edit, refuse to post, or to remove any information or materials, in whole or in part.

8.   License Granted. The American Public Health Association does not claim ownership of any information or material you transmit, distribute, post, communicate, or store on, to, or through the service. Public comments and discussions from within the blog become the property of the American Public Health Association and users grant a world-wide, royalty free, perpetual, unlimited, and non-exclusive license(s) to use, distribute, reproduce, modify, adapt, create derivative works, publicly perform and publicly display such content.

By posting or submitting content to this service, you also warrant and represent that you own or otherwise control all of the rights to the content of the public posting, and that use of your content by the American Public Health Association will not infringe or violate the rights of any third party. Users may only post information that they created or they have the express permission to post. This includes material that is copyrighted by other organizations or individuals.

9.   Disclaimer of Warranties and Limitation of Liability. THE SERVICE IS PROVIDED “AS IS.” THE AMERICAN PUBLIC HEALTH ASSOCIATION MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND WHATSOEVER TO YOU OR ANY OTHER PERSON RELATING IN ANY WAY TO THE SERVICE, INCLUDING ANY PART THEREOF, OR ANY WEB SITE OR OTHER CONTENT OR SERVICE THAT MAY BE ACCESSIBLE DIRECTLY OR INDIRECTLY THROUGH THE SERVICE. ORGANIZATION DISCLAIMS TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY AND ALL SUCH REPRESENTATIONS AND WARRANTIES.
In no event will the American Public Health Association or its affiliates, or any party involved in creating, producing, or delivering this service, or on any Web site linked to this service, be liable in any manner whatsoever for any direct, incidental, consequential, indirect, special, or punitive damages arising out of your access, use or inability to use this service or any site linked to this service, or in connection with any failure of performance, alteration, error, omission, interruption, defect, delay in operation or transmission, computer virus, or line or system failure.

10.   Choice of Law and Forum. These conditions shall be governed by and construed in accordance with the laws of the District of Columbia, excluding its conflict of law rules. You and the American Public Health Association expressly agree to submit to the exclusive jurisdiction and venue of the courts in the Illinois in all disputes arising out of or relating to the use of this service.

11.   Severability and Integration. These terms and conditions govern your use of the service. the American Public Health Association reserves the right to make changes to the service and to these conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.

12.   No Professional Advice. Any information supplied on the service and/or by any employee or agent of the American Public Health Association, whether by telephone, e-mail, letter, facsimile, or other form of communication, does not constitute medical, legal, tax, accounting, or other professional advice. Individual situations and state laws vary and users are encouraged to obtain appropriate advice from qualified professionals in the applicable jurisdictions.

13. Comments. Comments do not reflect the views of the t he American Public Health Association; and we do not have any obligation to monitor, edit, or review any Comments on the Site. We assume NO responsibility or liability arising from the content of any such Comments nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such Comments on the Site. We reserve the right to remove comments that do not follow the rules stated in this policy.

The first time you leave a comment, editors will have to approve it for posting. We do that to ensure that you’re not a machine. During the week, first time moderation will typically occur within 24 hours, although this is not guaranteed.

You are strictly prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. We will fully cooperate with any law enforcement authorities or court order requesting or directing disclosure of the identity of anyone posting any such information or materials.

Comment content that contains any of the above will be removed from the site. Further, off-topic comments, comments revealing personal information (i.e., place of residence, personal history) about bloggers or other commenters will be removed from the site. We reserve the right to remove comments for any reason at any time.

14. Online and Mobile Alerts. www.generationpublichealth.org, from time to time, can provide automatic alerts and voluntary account-related alerts.

Automatic alerts are sent to you following certain changes made online to your account, such as a change in your Registration Information. You do not need to activate these alerts. Although you may have the option to suppress some of these automatic alerts, we strongly recommend that you do not since they are security-related.

Voluntary account alerts may be turned on by default as part of the Service. They may then be customized, deactivated or reactivated by you. These alerts allow you to choose alert messages for your accounts. www.generationpublichealth.org may add new alerts from time to time, or cease to provide certain alerts at any time upon its sole discretion. Each alert has different options available, and you may be asked to select from among these options upon activation of your alerts service.

Electronic alerts will be sent to the e-mail address you have provided as your primary e-mail address for www.generationpublichealth.org. If your e-mail address or your mobile device’s e-mail address changes, you are responsible for informing us of that change. Changes to your e-mail address or mobile number will apply to all of your alerts. You can choose to have alerts sent to a mobile device that accepts text messages (SMS messages). Standard messaging rates or other charges apply. Check with your mobile carrier for additional information.

Because alerts are not encrypted, we will never include your passcode or password. Alerts may include your ID/username and some information about your accounts. Anyone with access to your e-mail will be able to view the content of these alerts. At any time you may disable future alerts.

14. Termination.T he American Public Health Association may, in its sole discretion, terminate your password, account (or any part thereof) or your access to the Site, or remove and discard any communication transmitted by you, or information stored, sent, or received via the Site without prior notice and for any reason, including, but not limited to: (i) concurrent access of the Site with identical user identification numbers, (ii) permitting another person or entity to use your user identification number to access the Site, (iii) any other access or use of the Site except as expressly provided in these Terms of Service, (iv) any violation of the Terms of Service of these Terms of Service or the rules and regulations relating to the use of, the software and/or data files contained in, or accessed through, the Site, (v) tampering with or alteration of any of the software and/or data files contained in, or accessed through, the Site, or (vi) failure to use the Site or portion thereof on a regular basis. You may terminate your membership hereunder upon thirty (30) days written notice by you to t he American Public Health Association of your intent to terminate these Terms of Service. Termination, suspension, or cancellation of these Terms of Service or your access rights shall not affect any right or relief to which t he American Public Health Association may be entitled, at law or in equity. Upon termination of these Terms of Service, all rights granted to you will automatically terminate and immediately revert to t he American Public Health Association and its licensors.
